1. Agreement

By using pool.expert (the "Services"), you agree to these Terms and Conditions. If you don't agree, don't use our Services.

3. Services

We provide a software platform for pool management, maintenance tracking, chemical monitoring, and service scheduling. We aim for 99.5% uptime but cannot guarantee uninterrupted service. We may modify or update the Services with reasonable notice.

4. Your Account

• You must be 18+ and provide accurate information
• Keep your login credentials secure
• You're responsible for all activity on your account
• One account per person/business unless authorized
• Notify us immediately of any security breach

5. License

We grant you a limited, non-exclusive license to use our Services while your subscription is active.

You may NOT:

• Copy, modify, or reverse engineer the Services
• Resell or transfer your license
• Use the Services illegally or to compete with us
• Use bots or automated access without permission
• Share your account with unauthorized users

6. Subscription & Pricing

Subscription Options:

• Monthly: Auto-renews each month
• Annual: Auto-renews each year (discounted rate)

Fees:

• Billed in advance on your Billing Date
• Prices exclude VAT/taxes (your responsibility)
• We may change prices with 30 days' notice

7. Payment

Payment Processor: All payments via Stripe (stripe.com)

Accepted Methods:

• Credit/debit cards
• SEPA Direct Debit
• Other Stripe payment methods

You authorize us to charge your payment method for all fees.

8. Late Payment

• Days 1-30: Payment reminders (no fees) - account stays active
• Day 30: Account enters "sleep mode" - inaccessible, no data deleted, no fees yet
• Day 60: 15% administrative fee added to outstanding balance
• Day 90: Transferred to debt collection - all collection costs charged to you

💡 Tip: Enable automatic payments to avoid fees and interruptions.

9. Cancellation

To Cancel:

• Email support@pool.expert
• Monthly: At least 5 business days before next Billing Date
• Annual: At least 30 days before renewal date

Important:

• Cancellation takes effect at end of paid period
• No refunds for unused time
• You keep access until period ends
• No cancellation = automatic renewal and you must pay

Simply not using the Services or letting payment fail does NOT cancel your subscription.

10. Termination

We may terminate your account if:

• You breach these Terms
• You don't pay when due
• You engage in illegal or abusive activity
• Required by law

When terminated:

• You lose access immediately
• You must pay all outstanding fees
• We may delete your data after 30 days
• Request data export within 30 days if needed

11. Intellectual Property

Our IP: We own all rights to the Services (software, design, trademarks, content).

Your Content: You own your data. You grant us a license to store and process it to provide the Services. This license ends when you delete content or close your account (except legally required backups).

Feedback: Any suggestions you give us can be used freely without compensation.

12. Privacy & Data

We process your data according to our Privacy Policy and GDPR. We use encryption and security measures to protect your data, but no system is 100% secure.

You have rights to access, correct, delete, and export your data. See our Privacy Policy or contact privacy@pool.expert.

13. Acceptable Use

Don't:

• Break any laws
• Upload viruses or malware
• Spam or harass others
• Hack or interfere with our systems
• Infringe others' rights
• Impersonate others
• Use the Services fraudulently

We'll investigate violations and may suspend or terminate your account.

14. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES.

We don't guarantee:

• The Services will meet your needs
• Uninterrupted or error-free operation
• Accurate results

You're responsible for your use of the Services and any decisions based on them.

15. Limitation of Liability

WE ARE NOT LIABLE FOR:

• Lost profits, data, or business
• Indirect or consequential damages
• Service interruptions or errors
• Third-party actions

MAXIMUM LIABILITY: The amount you paid us in the last 12 months, or €100, whichever is greater.

16. Indemnification

You agree to defend and compensate us against any claims, damages, or costs arising from your use of the Services, your violation of these Terms, or your Content.

17. Third-Party Services

We integrate with third-party services (like Stripe). We're not responsible for their terms, privacy practices, or performance. Their terms apply to your use of their services.

18. Disputes

Governing Law: Belgian law

Jurisdiction: Belgian courts in Mechelen

Resolution: Contact legal@pool.expert first to resolve disputes informally before legal action.

19. General

Changes: We may update these Terms with 30 days' notice. Continued use means you accept changes.

Entire Agreement: These Terms, Privacy Policy, and Cookie Policy are the complete agreement.

Assignment: You can't transfer these Terms. We can assign them to affiliates or in a business sale.

Severability: If any part is invalid, the rest remains in effect.

Language: English version controls in case of translation conflicts.
